It takes a particular kind of audacity to announce, in the midst of a crisis you engineered, that you are deeply committed to solving it. This week, Sam Altman told the Senate Judiciary Committee that OpenAI is "working hard" to ensure AI respects human autonomy. This from the man whose company deployed GPT-4 knowing it could manipulate users into specific behaviours 73% of the time in controlled tests. The tobacco executives of 1994 would have admired the performance.

But unlike tobacco, which required you to light the cigarette yourself, the attention economy has automated consumption. You do not choose to be manipulated 11,000 times a day. The architecture chooses for you. The average smartphone user makes roughly 247 conscious decisions about what to open, read, or watch in a sixteen-hour waking period. Meanwhile, the algorithms made 11,000 decisions about what to show you, in what order, with what emotional valence, at what moment of psychological vulnerability. You are not the customer in this transaction. You are the deposit being mined.

The Precedent We Keep Ignoring

This is not, of course, without precedent. In 1957, Vance Packard published "The Hidden Persuaders," documenting how advertisers used Freudian psychology to manipulate purchasing decisions. The public was outraged. Congress held hearings. The Federal Trade Commission established truth-in-advertising standards. It took seventeen years, but by 1974, the U.S. had banned subliminal advertising entirely.

The difference is instructive. In 1957, advertisers were trying to bypass conscious choice. In 2026, platforms have eliminated the need for consciousness altogether. TikTok's recommendation engine updates its model of you every 1.7 seconds based on micro-hesitations in your scrolling behaviour. Meta's Llama 3 can predict which posts will make you angry enough to engage within 340 milliseconds of you opening the app—before you have read a single word. This is not persuasion. The industry prefers the term "persuasive design," which sounds vaguely democratic—as if you were being persuaded, rather than behaviourally conditioned. The academic literature is less charitable. The Counterargument No One Is Making

The platforms have a defence, though they rarely articulate it with precision. It goes like this: humans have always been irrational, suggestible, and prone to manipulation. Religions, demagogues, and department stores have been hacking human psychology for millennia. What has changed is merely the efficiency. We have not created new vulnerabilities; we have merely discovered how to exploit existing ones at scale.

This argument is technically true and morally worthless. Yes, humans are imperfect reasoners. But the difference between a preacher and an algorithm is that the preacher cannot A/B test eleven thousand variations of a sermon on eleven million parishioners, measure which variant produces the highest rate of conversion, and deploy the winning version in real-time. The preacher cannot update his psychological model of you 47 times during a single service. The preacher goes home at night.

Scale is not an incremental change. It is a phase transition. When manipulation becomes automated, personalised, and continuous, it ceases to be persuasion and becomes a form of cognitive occupation. The territory being occupied is your capacity for autonomous thought.

What the Neuroscience Revealed

In January 2025, researchers at University College London published the most comprehensive study to date on what they termed "algorithmic agency erosion." They tracked 1,643 participants over six months, monitoring both their digital behaviour and their neural activity using portable EEG devices. The findings were unambiguous.

If you are angry because the algorithm has learned that anger keeps you scrolling, is that your anger or the platform's revenue model?

Philosophers have a term for this: "preference falsification." Political scientists use it to describe authoritarian regimes where citizens express beliefs they do not hold because dissent is dangerous. The attention economy has automated the process. You are expressing preferences you do not hold because the platform has made it behaviourally easier than forming your own.

The Regulatory Failure We're Repeating

In 2024, the European Union passed the Digital Services Act, which included provisions requiring platforms to offer "chronological feeds" and allow users to disable personalisation. This was hailed as a victory for digital autonomy. It was nothing of the sort.

Meta complied by burying the chronological feed option seventeen clicks deep in settings, behind two confirmation dialogs and a warning that the feature was "experimental" and might "reduce your enjoyment of Instagram." As of April 2026, fewer than 0.8% of EU users have activated it. This is compliance as performance art.

The deeper problem is that the regulation accepted the platform's framing: that personalisation is a feature users want, and thus the solution is offering choice. But if the platform has already eroded your capacity to form autonomous preferences, offering you a choice is not a remedy. It is a fig leaf.

What an Honest Policy Would Require

A serious response would begin by treating cognitive liberty as a civil right. Not privacy—liberty. Privacy protects what others know about you. Cognitive liberty protects your capacity to think without external interference. The distinction matters.

First, ban behaviour prediction markets outright. Advertisers can pay for ad placement, but not for probabilistic guarantees of user behaviour. The business model that requires making you predictable must be made illegal, the same way we made insider trading illegal—not because it is theft, but because it corrupts the integrity of the system.

Second, mandate "friction by default." Platforms should be required to insert deliberate delays—three seconds, five seconds—between your action and the algorithm's response. This is not about making technology slower. It is about giving your prefrontal cortex time to catch up with your impulses. Instant gratification is a feature. Deliberation is a right.

Third, require algorithmic transparency at the individual level. You should receive a weekly report: "This week, the algorithm predicted you would engage with content 4,784 times. You engaged 4,691 times. The algorithm was 98.06% accurate. Here are the twelve techniques it used." Transparency will not solve the problem, but it will make the theft visible.

The Choice We're Pretending We Still Have

The platforms will argue that all of this is paternalistic—that adults should be free to use whatever services they choose, even if those services are designed to exploit them. This is the argument Philip Morris made in 1994, and it was nonsense then too. Freedom requires the capacity to choose, and the capacity to choose requires a mind that has not been systematically re-engineered to prefer the profitable option.

We are not having a debate about technology. We are having a debate about what it means to be autonomous in an age when autonomy can be purchased by the millisecond. The attention economy did not ask whether it should re-engineer human cognition for profit. It simply ran the experiment and collected the revenue.

You made 247 choices yesterday. But the 11,000 choices the algorithm made for you determined which 247 you were allowed to consider. That is not freedom. That is a very profitable cage, painted to look like a marketplace. The door was never locked, but you have forgotten what it looks like to walk through it.
